Potential Changes to Florida’s Workers Compensation Insurance

I recently came across an interesting article surrounding Florida’s workers compensation insurance being on the verge of change.  The article highlights the fact that workers advocates in Florida allege that business-friendly legislation has chipped away at the state’s workers comp system for years, ultimately leaving employees with inadequate support and no recourse in the courts – and some judges agree. 

 

Recently, a circuit court ruling declared the system unconstitutional and now many business leaders worry that workers comp premiums will soar.  The major flaw with Florida’s system is that the workers comp premiums employers needed to pay to support the system were unreasonable, according to some insurers and business leaders. In fact, according to most surveys, Florida’s premiums were among the highest in the country. 

 

The effects of August’s ruling against the current workers compensation laws have yet to be felt by workers outside of Miami-Dade County, however pending cases could change the law in Florida as a whole, with possible ripple effects in other states where workers comp is an issue as well.
