Legal Departments and the Hiring Process

Since I deal with many cases surrounding employment law, workplace issues are of interest to me. I recently came across an article addressing the issue of hiring employees that are the right fit, and the flawed system under which many companies operate in regard to this. The article surrounds a proposal for a workplace “Yelp,” which would incorporate aspects of LinkedIn and Match.com. As opposed to the impersonal reference check process that exists today, this thorough approach would provide employers and HR managers with a more complete vision of potential employees’ trustworthiness, social abilities, and overall fit into their company’s culture.

 

A major problem with the current hiring process is that some companies’ legal departments do not allow managers to offer assessments of former employees, whether positive or negative. With every new hire, companies assume a certain level of legal and social responsibility for them, and without any background information, employers often end up taking a big risk. As the social media world continues to grow, opportunities for increased transparency in the hiring process abound, and should be taken advantage of.
